Magma Math ("Magma Math," "we," "our" or "us") is a service (the "Service") provided by Radish Education Canada Inc., an Ontario corporation (the "Company"), and developed by Radish AB, for teaching and learning mathematics. The Service gives users a platform for solving problems and for supporting the interaction between students ("Student Users"), teachers, and administrators ("Educator Users") in an educational setting. By using the Service, you agree to these Terms of Use ("Terms").
Each time you visit or use the Service, you agree to be bound by these Terms, which set out your rights, obligations, and restrictions. If you do not agree, you should stop using the Service. We may update these Terms from time to time and will notify you of material changes by email and by posting the updated Terms on the Service.
In addition to these Terms, we have adopted the Magma Math Privacy Policy (Canada). Please read it for information about how we collect, use, and disclose personal information.
Magma Math is a platform for students and educators. We collect personal information through the Service only for the use and benefit of the educational institution / school board, and for no other commercial purpose.
Where required by applicable provincial education and privacy law, the educational institution (school board, school, and/or teacher) is responsible for obtaining any consent required for the collection and use of a student's personal information. If you are a teacher, you represent and warrant that you have authorization from your school and/or board to use the Service and to enter into these Terms on its behalf, and that any required consent has been or will be obtained by the institution.
If you are a student, please do not provide personal information to us beyond what the Service requests, and only where your school, board, and/or teacher has the authority to permit it. If we learn we have received student personal information without the institution's authority, we will delete it as promptly as reasonably possible. You represent and warrant that you are of legal age to form a binding contract or that you have permission from your parent or guardian, or, where you agree to these Terms on behalf of an organization, that you are authorized to bind that organization.
Educator Users and Student Users generally require an account ("Account") to access certain features. Educator Users sign up on the Site; Student Users are added by an Educator User through a class code or by manual entry.
From your Account you can create, edit, and share work product with other users in your classroom — typically math problems and solutions, which may include text, whiteboard images, graphics, videos, photographs, audio clips, comments, or other materials ("Content"). Educator Users may access a "Teacher Dashboard" to view student work and change student settings.
Magma Math does not warrant that Content it creates is accurate, complete, reliable, current, or error-free. If you are dissatisfied with the Service, your sole remedy is to stop using it and terminate your Account.
Your account information. To create an Account, users must provide a valid name; Educator Users must also provide a valid email address and school name. You are responsible for the accuracy of the information you provide, for creating a secure password, and for protecting your Account from unauthorized access. Notify us immediately at legal@magmamath.com if you believe your credentials have been compromised. You will be held responsible for any activity that occurs under your Account, and you acknowledge that you are solely responsible for all damages or claims that may arise from any access to or use of the Service by any person to whom you have provided your username, password, or other identifying information, or by any person who has obtained such information from you, including any access or use occurring after you have notified us that your credentials have been lost, stolen, or otherwise compromised. You will not impersonate, abuse, harass, threaten, stalk, or intimidate others through your Account.
Contributing content. By contributing Content you agree that:
- your Content is visible only to users within your classroom or otherwise authorized by you or the administering teacher;
- Content that is offensive, indecent, or otherwise inappropriate may be removed without notice;
- all Content must comply with applicable law, including Canadian copyright law, and you represent and warrant that (i) you own or otherwise possess all rights to use your Content; (ii) you have permission to use the name and likeness of each identifiable individual and to use such individual's identifying or personal information; (iii) you are authorized to grant all of the rights described in these Terms; and (iv) the use of your Content as contemplated by these Terms will not infringe or violate the intellectual property, privacy, publicity, contract, or other rights of any person or entity. If you do not have the right to submit Content for such use, it may subject you to liability;
- you are solely responsible for your Content and conduct; and
- your Content may be adapted (for example, photos cropped) to meet technical requirements; you are responsible for retaining original copies.
Your Content belongs to you. You retain all rights you hold in your Content, but by providing it to Magma Math you grant us a limited, non-exclusive licence solely to perform our obligations under these Terms, and you grant each authorized user a non-exclusive licence to view, download, and use your Content as contemplated by the Service.
Removal of your account and content. You may disable your Account at any time via the Magma Math website; disabling does not automatically delete your personal data (see the Privacy Policy for deletion). We may monitor and review Accounts, Content, and activity for compliance, and may remove or disable an Account or Content for any reason, including violation of these Terms. We will try to contact you by email before removal but are not obligated to. We may reclaim usernames that infringe legal or trademark rights, or that have been inactive for six months or more.
Subscription fees. Creating an Account is free. We reserve the right to charge a subscription fee to teachers or administrators. If you subscribe, you will pay all applicable fees and related taxes (including, where applicable, GST/HST). We may use a third-party payment processor, whose terms and privacy policy will also apply.
Permitted use. The Service is for educational, non-commercial use only. You may not modify the Service or use it for any purpose other than as described in these Terms. We may deny access to the Service at our discretion.
Intellectual property. We and our licensors own all proprietary rights in the Service. The Service may not be reproduced, copied, sold, or otherwise exploited for commercial purposes without our written consent. You may not reverse engineer, decompile, or create derivative works of any part of the Service. "Magma Math" and related logos and designs are trademarks of Magma Math; other marks are the property of their respective owners.
If you believe Content on the Service infringes your copyright, you may send us a notice of claimed infringement in accordance with the notice-and-notice regime under the Copyright Act (Canada), sections 41.25 to 41.27. Your notice should include: a statement identifying the work and the allegedly infringing Content; sufficient information to locate the Content; your name and contact information; and a statement of your good-faith belief and your authority to act. On receiving a compliant notice, we will act as required by the Copyright Act.

Linking to third-party websites. For your convenience, the Service may provide links to third-party websites, including our payment processor. Unless expressly stated otherwise, Magma Math does not endorse, approve, sponsor, or control, and is not in any way responsible for, any of the content, services, information, products, or materials available at or through any website to which the Service links. By using the Service, you acknowledge and agree that Magma Math will not be responsible or liable to you or any other person for any damages or claims that may result from your use of such content, services, information, products, or materials. You should carefully review each website's privacy statements and conditions of use to understand your rights and responsibilities.
Indemnification. You agree to indemnify and hold harmless Magma Math, its parent, subsidiaries, affiliates, directors, officers, agents, partners, and employees from any claims, damages, losses, liabilities, and reasonable legal costs arising out of your Content, Account, use of the Service, or violation of these Terms.
Disclaimer and limitation of liability. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. TO THE EXTENT PERMITTED BY LAW, MAGMA MATH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE. TO THE EXTENT PERMITTED BY LAW, MAGMA MATH'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE CANADIAN DOLLAR (CAD $1.00). Some jurisdictions do not allow certain limitations, in which case some of the above may not apply to you and you may have additional rights.
Termination. We may suspend or terminate your access to the Service for any reason, including breach of these Terms. Provisions relating to Content, representations and warranties, indemnities, and limitations of liability survive termination.
Governing law and jurisdiction. We operate the Service from our offices in Canada. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules. Any action relating to thes
